Understanding the Bankruptcy Process
Helping you understand the bankruptcy process and walking you step by step through the process is a key aspect of the Sutterfield Law Firm. Every client receives personal attention and works directly with me, Joshua A. Sutterfield, Esq., so that I can fully explain your legal rights and give you a full understanding of how the bankruptcy process works here in California.
I personally handle all aspects and stages of the bankruptcy process, including preparation of the bankruptcy petition and attendance at the 341 court hearing. I understand the decision to file can be a difficult and stressful decision to make. That is why I believe it is important to select an experienced and knowledgeable attorney who personally works with his clients throughout the entire process. You should not settle for less!
Overview of the Process:
Step 1:
Consultation: Contact the Sutterfield Law Firm to schedule a free initial consultation. From my Roseville, California office, I will personally evaluate your situation to help you determine if Chapter 7 or Chapter 13 bankruptcy is right for you. Contact Us 916.760.2400.
Step 2:
Moving Forward: After meeting with me personally to consider your options, I can help you move forward once you retain my Firm. Fees for Chapter 7 bankruptcy vary depending upon the complexity of the case. I have payment plans available so that you can begin the process by putting down as little as $250 and paying the rest of the retainer and filing fee over time.
Also, once our Firm is retained in your case, you may immediately start referring annoying creditor calls to my office!
Step 3:
Paperwork: I will provide you an online or paper questionnaire to complete and a list of documents I will need to assemble your petition. I will be available throughout the entire process to answer any questions you may have. You will also need to complete a pre-filing bankruptcy credit counseling course, which may be done on the internet.
Step 4:
Filing your case: Once I have received all the necessary information, received payment in full for my legal services and the filing fee, and your certificate for the pre-filing bankruptcy credit counseling course, you will sit down with me to review and sign your bankruptcy petition. Once your petition is reviewed and signed, my office with electronically file your case with the court. After the case is filed, you will need to complete a second post-filing bankruptcy credit counseling course, which may be done on the internet.
Step 5:
Hearing: Once you case is filed you will need to attend a 341 court hearing in front of a trustee. I am present with my clients at this hearing. The hearing is typically scheduled 30 to 40 days after your case is filed.
Step 6:
Discharge: A bankruptcy discharge typically comes 60 to 90 days after your 341 hearing.
