What Will Happen in Chapter 7 Bankruptcy?

Both Chapter 7 and Chapter 13 bankruptcy will stop wage garnishment, and temporarily stop foreclosure on a home and repossession of a car. The biggest difference between these two forms of foreclosure is that Chapter 7 will "discharge" unsecured debt. That means that some or all of your unsecured debt will be completely gone. Chapter 7 truly allows you to start over.

  • What is Unsecured Debt? A couple of examples of unsecured debt are credit card debt and medical bills. These are debts that cannot be collected by repossessing property (like a car). Since credit card debt and high medical bills are among the most serious financial problems for many people, getting rid of that debt completely with Chapter 7 bankruptcy can make a big difference in their financial picture.
  • What is Secured Debt? A home mortgage or car loan are secured debts. This means that your home or car could be repossessed by the lender. When you file for bankruptcy, any foreclosure or repossession is put on hold. Bankruptcy gives you time to look for options.
  • Are There Debts that Won't be Discharged? Yes, tax debts, student loans, and child and spousal support debts will not be dismissed in either Chapter 7 or Chapter 13 bankruptcy. But there are other options for handling tax debt and we can talk about those.
  • Can My Creditor's Take my Car? Some property is exempt from being taken by creditors. Your car may be exempt, depending upon its value. Other exempt property includes clothes, the tools of your trade and personal items.
